These Terms and Conditions (hereinafter, the "Terms") govern access to and use of the website klarismx.com (hereinafter, the "Site") and the services offered by Klarismx S.A. de C.V. (hereinafter, "Klarismx"), a company incorporated under the laws of Mexico, with domicile at Av. Paseo de la Reforma 505, Floor 32, Col. Cuauhtémoc, C.P. 06500, Mexico City.
1. Acceptance of Terms
By accessing or using the Site, you agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy. If you do not agree with any of these terms, you should not use the Site or the services. Continued use of the Site after the publication of modifications constitutes acceptance of said changes.
2. Service Description
Klarismx operates a digital collective real estate investment platform (real estate crowdfunding). Through the Site, users can explore investment opportunities in real estate projects located in Mexico City and the metropolitan area. The information presented on the Site is informational in nature and does not constitute financial, legal, or tax advice.
3. Requirements for Use
To use Klarismx's services you must: be at least 18 years old, have legal capacity to enter into contracts in Mexico, provide truthful, complete, and up-to-date information during the registration process, and not use the Site for illegal activities or activities contrary to these Terms. Klarismx reserves the right to verify users' identities in accordance with applicable Anti-Money Laundering and Counter-Terrorism Financing provisions.
4. Investment Risks
Real estate investments carry inherent risks, including but not limited to: partial or total loss of invested capital, fluctuations in property values, delays in project execution, changes in applicable regulations, and market and liquidity risks. Klarismx does not guarantee specific returns or the recovery of invested capital. Past returns are not indicative of future results. Each user is responsible for evaluating their own financial situation and risk tolerance before making any investment.
5. Intellectual Property
All content on the Site — including text, graphics, logos, icons, images, audio, video, software, and source code — is the property of Klarismx or its respective owners and is protected by intellectual property laws of Mexico and applicable international treaties. Reproduction, distribution, modification, or any other unauthorized use of the Site's content is prohibited.
6. Limitation of Liability
The Site is provided "as is" and "as available." Klarismx does not guarantee that the Site will be free of errors, interruptions, or viruses. To the maximum extent permitted by Mexican law, Klarismx shall not be liable for direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Site or services. This site is for informational purposes only and is not responsible for the loss of funds.
7. Privacy and Data Protection
The processing of personal data is governed by our Privacy Policy, available on the Site, in accordance with the LFPDPPP and other applicable regulations.
8. Applicable Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the United Mexican States. For the resolution of any dispute arising from these Terms, the parties submit to the jurisdiction of the competent courts of Mexico City, expressly waiving any other jurisdiction that may correspond to them by reason of their present or future domicile.
9. Modifications
Klarismx reserves the right to modify these Terms at any time. Updated versions will be published on the Site with the date of the last update. It is the user's responsibility to periodically review these Terms.
